Atnda Terms of Service

Welcome to Atnda! These Terms of Service ("Terms") govern your use of the services provided by Atnda, accessible via www.atnda.com (the "Site"). By accessing or using our Site, you agree to be bound by these Terms. Please read them carefully.

1. Introduction

Atnda is a platform that connects qualified teachers with local schools for the purpose of tutoring students. Teachers can book classrooms in participating schools, and students can register for lessons in their area. Atnda charges a fee from the earnings of teachers and schools for providing this service.

2. Acceptance of Terms

By using our services, you acknowledge that you have read, understood, and agree to be bound by these Terms. If you do not agree to these Terms, you must not use the Site or the services provided by Atnda.

3. Eligibility

To ensure a safe and professional environment, Atnda’s services have specific eligibility requirements that all users must meet.

  1. Age Requirement:
    Our services are intended for use by individuals who are 18 years of age or older and who have the legal capacity to enter into binding agreements.
  2. Minors’ Access:
    Individuals who are under 18 but at least 13 years old may use our services only with the involvement and supervision of a parent or legal guardian. The parent or guardian assumes full responsibility for the actions and activities of the minor while using the services. Users under the age of 13 are not permitted to use Atnda’s services under any circumstances.
  3. Teacher Qualifications:
    Teachers wishing to use Atnda must have valid teaching qualifications and hold a current enhanced DBS certificate. By signing up as a teacher, you affirm that the information you provide is accurate, complete, and current. You are also responsible for maintaining your DBS status and ensuring ongoing compliance with all legal requirements.
  4. School Responsibilities:
    Schools participating in Atnda must ensure that all individuals who have access to their Atnda account have undergone an enhanced DBS check. It is the responsibility of the schools to verify the credentials and safeguarding status of these individuals and to ensure their compliance with legal obligations.

By using Atnda, you agree to abide by these eligibility conditions, ensuring a safe and effective platform for all users.

4. Obligations

4.1. Verification

Atnda may request that teachers provide a government-issued ID (e.g., passport, driver’s license) along with documents verifying their educational credentials (e.g., diplomas, certificates). Teachers will be asked to upload these documents during the verification process. Once a teacher passes verification, a special badge will be added to their profile, and the uploaded documents will be securely deleted from our servers.

Atnda does not endorse or guarantee the accuracy, completeness, or reliability of any information provided by teachers during the verification process. While we strive to verify users' identities, Atnda cannot confirm that each user is who they claim to be. By using our platform, you agree to assume all risks associated with interactions, both online and offline, with other users.

When interacting with others through Atnda, please exercise caution and use common sense to protect your personal safety and property. Atnda, its affiliates, and licensors are not responsible for the conduct of any user, whether online or offline, and will not be liable for any claims, injuries, or damages arising from your use of the services.

4.2. Background Checks

Atnda may utilize third-party agencies to conduct background checks, including criminal history, sex offender registry, and identity verification checks ("Background Reports"). Atnda does not endorse or guarantee the reliability, accuracy, or completeness of these Background Reports.

By using Atnda, you consent to the collection, use, and disclosure of information obtained through Background Reports. Atnda may, at its sole discretion, review and act upon the information from these reports, including suspending or terminating user accounts. However, Atnda is not responsible for any inaccuracies, delays, or incomplete information in these reports. Users may contact the third-party agency directly to dispute any findings.

4.3. Payment

Payment processing on the Atnda platform is handled by third-party payment processors such as PayPal, Stripe, and others. These processors enable Atnda to:

5. Rights and Limits

5.1. Your Right to Use the Atnda Platform

For Students: Atnda grants you a non-transferable, non-sublicensable, non-exclusive, limited right to access and use the Atnda Platform solely for personal, non-commercial purposes as set forth in these Terms.

For Teachers: Atnda grants you a non-transferable, non-sublicensable, non-exclusive, limited right to access and use the Atnda Platform solely for providing tutoring services to Students.

For Schools: Atnda grants you a non-transferable, non-sublicensable, non-exclusive, limited right to access and use the Atnda Platform to manage classroom bookings and other related functions.

You agree not to use automated means (such as scripts, bots, spiders, crawlers, or scrapers) to access or collect content from the Atnda Platform, except as allowed by standard search engines or internet browsers. You also agree not to use data mining technology to extract or frame content from the Atnda Platform without our explicit written permission.

You agree not to engage in any activities that would involve Teachers completing assignments, writing papers, taking quizzes, or otherwise performing tasks on your behalf. Additionally, you agree not to use our Services in any way that violates academic integrity policies or conduct codes of your educational institution or workplace.

Materials provided by Atnda as part of our Services may not be copied, reproduced, modified, republished, downloaded, uploaded, posted, transmitted, or distributed in any form or by any means without our prior written consent, unless explicitly permitted by these Terms. You may not share or transfer your account credentials with any third party.

Atnda reserves the right to impose reasonable limits on your access to the Platform, including restrictions on time, volume of information, or devices used, to prevent unauthorized use.

All rights not expressly granted herein are reserved.

5.2. Your Account

Certain features of our Services are available only to registered users. To register, you must create an account as a Student, Teacher, or School on the Atnda Platform. You are responsible for protecting your account credentials from unauthorized use and for all activities conducted under your account. If you suspect your account credentials have been compromised, you must notify us immediately so that appropriate action can be taken.

You may use the Atnda website and its features without registering, but you will still be subject to these Terms and other applicable rules and policies. You may not create more than one account in each category (i.e., one as a Teacher, one as a Student, and one as a School) or share your account credentials with any third party. You may not rent, resell, or otherwise provide access to the Atnda Platform to any third party.

When you create an account on Atnda, we may collect personal data directly from you, or if you use a third-party service (e.g., Facebook, Google), we may collect personal data from that service. By using a third-party service to create your account, you authorize us to collect the necessary personal data for account authentication.

You may upload a profile photo or connect other social media accounts, but this is not required. The security of any personal data you provide is governed by our Privacy Policy.

For Teachers: It is mandatory to provide a profile photo and a video introduction. Adding more details to your profile, such as your educational background and work experience, is optional but can enhance your visibility and effectiveness on the Platform.

5.3. Direct Interactions

Atnda does not participate directly in interactions between Students, Teachers, and Schools, except when necessary to: (a) Ensure compliance with these Terms; (b) Improve our Services; or (c) Address issues related to our Refund and Payment Policy.

We do not control the services provided by Teachers, the reviews or ratings given by Students, or any actions or omissions by Users.

5.4. Representations and Warranties

Teacher-Specific Representations

If you use the Services as a Teacher: (i) You agree to provide tutoring services in accordance with these Terms and Atnda’s policies. (ii) You will comply with all applicable laws and regulations in your jurisdiction. (iii) You are responsible for adhering to local laws related to your tutoring services. (iv) You will deliver tutoring services with reasonable care and according to recognized practices. (v) You will maintain all necessary registrations, certifications, and licenses required for providing tutoring services. (vi) You will not provide tutoring services outside of the Atnda Platform, accept payments directly from Students, or solicit payments outside of the Atnda Platform. (vii) You acknowledge that Atnda may advertise your services without additional compensation. (viii) You agree that Atnda may edit and use your video introduction for promotional purposes.

Student-Specific Representations

If you use the Services as a Student: (i) You agree to honor commitments made to Teachers via the Atnda Platform. (ii) You will not attempt to manipulate or circumvent the fee structure or billing process. (iii) You agree to engage with Teachers in good faith.

School-Specific Representations

If you use the Services as a School: (i) You agree to manage classroom bookings in accordance with these Terms and Atnda’s policies. (ii) You will ensure that classroom availability and conditions meet the standards required for tutoring sessions.

5.5. Teachers' Introduction Video and Profile Photo

Teachers grant Atnda the right to use their introduction video, name, and profile photo for marketing, advertising, or promotional purposes, including on social media and video hosting platforms. You may request removal of your introduction video from these platforms by contacting contact@atnda.com.

Atnda uses various factors to rank Teachers for Students, including:

If you have a complaint about our Services, please contact Atnda at contact@atnda.com with “Formal Complaint” as the subject line. We will acknowledge receipt of your complaint and investigate the matter. If the complaint involves a specific Atnda representative, another representative will handle the investigation.

5.8. Lesson Recording

Atnda may record lessons to ensure service quality. These recordings are not used for marketing purposes and are not shared externally. By using our Services, you consent to such recordings. You may opt out or request removal of any recordings by contacting contact@atnda.com.

Atnda charges a fee from the earnings of both teachers and schools. The fee structure is detailed on our Site and is subject to change at any time. By using our services, you agree to the applicable fees and authorize Atnda to deduct these fees from your earnings.

Payments are processed securely through our platform, and funds will be disbursed according to the schedule provided on our Site. All transactions must be completed through Atnda; any attempts to circumvent our payment system may result in account suspension or termination.

8. Cancellation and Refund Policy

Cancellations and modifications to bookings must be made through the Atnda platform. Our refund and payment policy, which is part of these Terms, outlines the conditions under which refunds may be issued. Teachers, students, and schools are expected to adhere to the cancellation terms provided at the time of booking.

13. Limitation of Liability

Atnda is not liable for any indirect, incidental, special, or consequential damages arising out of or in connection with the use of our services. Our total liability to you for any claims arising from your use of the Site or services shall not exceed the amount you have paid to Atnda in the 12 months preceding the claim.

Atnda reserves the right to terminate or suspend your account at any time, with or without notice, for any reason, including but not limited to a violation of these Terms.

15. Governing Law

These Terms are governed by and construed in accordance with the laws of the United Kingdom. Any disputes arising out of or related to these Terms shall be subject to the exclusive jurisdiction of the courts of England and Wales.

Atnda may update these Terms from time to time. We will notify you of any significant changes by posting the new Terms on our Site. Your continued use of the Site after the posting of revised Terms constitutes your acceptance of the changes.
